Smoking Shelters

The Health Act 2006 came into effect on the 1st July 2007. The Act provides for the prohibition of smoking in various premises open to the public and/or used as a workplace, and certain vehicles.

Places such as pubs, restaurants, betting offices, offices, etc. became smoke-free premises (for more information visit Smokefree England Opens in a new window).

As a result of the legislation, proprietors may seek to make provision for smokers outside their 'enclosed' main building. Planning permission is likely to be required for such structures.

Applications should be made to Surrey Heath Borough Council using the Application for Planning Permission forms (1APP) - (Planning Portal Opens in a new window -. (Please note 4 copies of the application form and plans are required when submitting in hard copy).
