Local Land Charges were the creation of the Land Charges Act 1925. They were originally designed to ensure that purchasers of land were not caught unaware by obligations enforceable against them by local authorities under various statutes.
The principal current statutory provisions are contained in the Local Land Charges Act 1975 and the Local Land Charges Rules 1977.
A local land charge is a restriction on a particular parcel of land, either to secure payment of a sum of money, or limiting the use to which the land may be put, and is binding on successive owners or occupiers of that parcel of land. The register of local land charges is maintained in a computerised Geographic Information System.
Local land charges is a specialist service. It deals with searches and enquires from solicitors acting on behalf of property buyers, land developers, financial institutions, government departments, utilities like the water board, electricity, gas, railways and other bodies as well as private individuals.
Enquiries of the Local Authority will involve answering upto 69 standard questions on road and railway schemes proposals, planning history, and many other matters affecting the property. In order to reply fully information is obtained from Surrey County Council. It should be noted that a Local Search only relates to the property details of neighbouring properties/land must be requested and will be charged at a separate fee.
